  1. Interpretation

1.1 Definitions

“Booking” means any reservation made by a Guest or group of Guests for a Sailing.

“Charity” means Vigilance of Brixham CIO (Charity No. 1168570).

“Contract” means the agreement between the Guest and the Charity for a Sailing.

“Crew” means all crew members appointed by or on behalf of the Charity.

“Guests” means all persons participating in a Sailing under a Booking.

“Illegal Drugs” means any substances controlled under the Misuse of Drugs Act 1971.

“Instructions” means directions given by the Skipper or authorised Crew.

“Sailing” means any voyage of the Vessel with Guests onboard.

“Skipper” means the person in command of the Vessel.

“Vessel” means BM76 Vigilance of Brixham.

1.2 Interpretation

References to any gender include all genders.

Singular includes plural and vice versa.

  1. Basis of Contract

By making a Booking:

- The Charity agrees to provide the Sailing in accordance with these terms

- The Guest agrees to comply with these terms

- These terms apply to the entire Contract

  1. Guest Obligations

3.1 The Skipper has overall authority.

3.2 All Instructions must be followed.

3.3 No smoking or vaping onboard.

3.4 Alcohol only with permission.

3.5 No illegal drugs.

3.6 No animals unless agreed.

3.7 Under 16s must be accompanied.

3.8 Lifejackets must be worn when instructed.

3.9 Participation is at own risk.

3.10 Behaviour must not endanger others.

3.11 Guests may be removed for unsafe behaviour without refund.

  1. Charity Obligations

4.1 Provide competent crew.

4.2 Ensure safety.

4.3 Maintain insurance.

4.4 Provide safety equipment.

4.5 Operate with reasonable care.

  1. Cancellations & Changes

5.1 By Charity:

- Rebooking or refund if cancelled before departure

- Partial refund may be offered if curtailed

5.2 By Guests:

- 14+ days: full refund

- 7–14 days: 50% refund

- <7 days: no refund

  1. Liability

Nothing limits liability for death or injury due to negligence.

Charity not liable for personal belongings or indirect loss.

  1. Safety

Skipper decisions final.

  1. Photography

Photos and videos may be taken and used for marketing.

Guests may opt out by informing crew.

  1. General

Governed by law of England and Wales.

  1. Weather

Sailings subject to weather.

Rain alone does not justify cancellation.

  1. Minimum Passengers

Minimum 3 passengers required.

  1. Late Arrival

No delay for late guests.

No refund for no-shows.

  1. Group Bookings

3.1 Where a Booking is made on behalf of a group, the person making the Booking (“Lead Booker”) confirms that:

  • They are authorised to act on behalf of all Guests in the group
  • All Guests have been made aware of and agree to these Terms and Conditions

13.2 The Lead Booker is responsible for:

  • Providing accurate information about all Guests
  • Ensuring all Guests comply with these Terms
  • Acting as the main point of contact with the Charity

13.3 The Charity may communicate solely with the Lead Booker in relation to the Booking, and such communication shall be deemed to have been communicated to all Guests.

VIGILANCE IS A GAFF-RIGGED KETCH

Still classed as a "Brixham Sailing Trawler" although no longer fishing. She was the last of a long line of beam trawlers or smacks built at Upham's Shipyard in Brixham in 1926. As a heritage vessel of national importance, she is part of the UK Historic Fleet.
